1. INTRODUCTION
Welcome to Grimzap ("Company," "we," "us," or "our").
Grimzap operates this website and online store, including all related content, information, tools, products, and services (collectively, the "Services"). The Services are hosted and powered by Shopify Inc.
These Terms of Service ("Terms") constitute a legally binding agreement between you and Grimzap and govern your access to and use of the Services, as well as the purchase and use of any products offered through the Services.
BY ACCESSING, USING, OR PURCHASING FROM THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER SET FORTH BELOW.
If you do not agree to these Terms, do not use the Services.

3. ELIGIBILITY
By using the Services, you represent and warrant that:
You are at least 18 years old
You have the legal capacity to enter into a binding agreement
All information you provide is accurate and current
Purchases are for personal, non-commercial use only, unless expressly authorized in writing by Grimzap
We reserve the right to refuse service, cancel orders, or terminate access for violations of these Terms.
You are responsible for all activity conducted under your account.
4. PRODUCT CATEGORY AND INTENDED USE
The Grimzap device is a USB-rechargeable handheld consumer electronics product: a powered cleaning brush sold as a kit consisting of a handle/motor unit, one or more interchangeable brush heads, and a USB charging cable. It is intended solely for cleaning and scrubbing hard household surfaces by adult users.
The product:
Is a general consumer electronics and cleaning product, and is not a medical device, therapeutic device, or personal-care/grooming device
Is intended for use only on suitable hard household surfaces, such as bathroom tile, grout, sinks, tubs, kitchen surfaces, and similar areas, consistent with the included instructions
Is NOT intended for use on people, animals, skin, scalp, hair, teeth, nails, or any part of the human or animal body
Must be operated by an adult and kept away from children
Only the brush heads are rated waterproof (IPX7); the handle/motor unit and the charging cable are not waterproof and must be kept dry (see Section 5)
You agree to use the product only for its intended purpose and in accordance with these Terms and the instructions provided with the product.
5. WATER AND WATERPROOFING SAFETY
This product has a mixed water-resistance rating. You must understand and follow the following before use:
Only the brush heads are rated IPX7 waterproof and may be rinsed or briefly submerged (approximately up to 1 meter for up to 30 minutes) for cleaning
The handle/motor unit and the USB charging cable are NOT waterproof and must be kept dry at all times
Do not submerge, soak, or immerse the handle/motor unit in water or any liquid
Do not hold or rinse the handle/motor unit under running water
Do not use the device while it is connected to the charging cable, and do not charge the device in or near water, sinks, tubs, showers, or wet or damp locations
Detach the brush head before rinsing it; reattach it to the handle only when the head and the handle connection are dry
Before cleaning the handle, power off and disconnect the charging cable, then wipe the handle only with a damp (not soaked) cloth; never immerse it
Discontinue use immediately if water enters the handle/motor unit or if the device behaves abnormally after contact with liquid
Allowing water or liquid to enter the handle/motor unit or charging components can cause electric shock, short circuit, battery failure, fire, or permanent damage to the device. Damage caused by exposing non-waterproof components to water is considered misuse.
6. GENERAL USE AND PHYSICAL SAFETY
This product has a powered, moving brush head. To reduce the risk of injury or damage, you must:
Keep hair, loose clothing, jewelry, fingers, and other body parts clear of the moving brush head during operation
Avoid splashing water, debris, or cleaning solution toward your eyes or face; eye protection is recommended when cleaning overhead or with chemical cleaners
Use the device only on suitable hard household surfaces, and test it first on a small, inconspicuous area, as the brush may scratch, dull, or damage delicate, polished, coated, or soft surfaces
Never use the device on yourself, other people, children, animals, skin, scalp, hair, teeth, or the body
Stop using the device immediately if it jams, stalls, overheats, or behaves abnormally
Keep the device, brush heads, and charging cable out of the reach of children, and supervise the area when children or pets are present
7. CLEANING AGENTS AND CHEMICALS
This product is supplied without cleaning agents. You are responsible for any cleaning products you choose to use with the device.
Use only cleaning products that are appropriate for the surface being cleaned, and follow the instructions and warnings provided by the manufacturer of each cleaning product
Never mix cleaning chemicals (for example, bleach and ammonia-based products), as this can create hazardous fumes
Some cleaning agents, solvents, or abrasives may damage the brush heads, the handle, or the surface being cleaned; if in doubt, test on a small area first
Grimzap is not responsible for any injury, damage, or harm arising from third-party cleaning products used with the device, or from the misuse, mixing, or improper handling of such products
8. ELECTRICAL AND BATTERY SAFETY
This product contains a built-in lithium-ion rechargeable battery and is charged using the included USB charging cable. No wall plug or AC power adapter is included. By purchasing and using this product, you acknowledge and agree to the following:
Charge the device only with the included USB cable connected to a quality, compliant USB power source of the appropriate rating; do not use damaged cables or power sources
Do not use the device while it is connected to the charging cable
Do not charge or expose the device to water, liquids, moisture, or extreme temperatures, and keep the cable and charging connection dry and out of reach of children
Do not cover or obstruct the device while charging
Discontinue use immediately and contact us if the device is physically damaged, shows signs of battery swelling, emits unusual heat, produces burning odors, or behaves abnormally
Do not attempt to open, disassemble, modify, or repair the device
Dispose of the device in accordance with local electronic waste (e-waste) regulations at the end of its useful life; do not dispose of in household waste
Lithium-ion batteries require safe handling and proper disposal. For battery safety questions, consult your local hazardous waste authority.
9. NO HEALTH OR MEDICAL CLAIMS
The Grimzap device is a general consumer cleaning product. By reducing the bending, kneeling, reaching, and manual scrubbing effort involved in cleaning by hand, it may make certain cleaning tasks easier or more convenient. This is a description of how the product works mechanically, not a health or medical claim.
The product is:
NOT a medical device, therapeutic device, or health device
NOT intended to diagnose, treat, cure, relieve, mitigate, or prevent back pain, joint pain, knee pain, muscle strain, or any disease, disorder, injury, or medical condition
NOT a substitute for professional medical advice, physical therapy, or licensed healthcare services of any kind
Any references on the Services to comfort, reduced strain, less bending, or "saving your back" describe the reduced physical effort of using a powered cleaning tool instead of scrubbing by hand. They are not promises of any health benefit or medical outcome. If you have back pain, joint pain, a physical limitation, or any health concern, consult a licensed physician before performing cleaning or other physical tasks.
Individual experiences vary widely. No specific health, comfort, or cleaning outcome is guaranteed.
10. PRODUCT SAFETY AND COMPLIANCE
This product is designed for consumer use and is sourced from third-party manufacturers. We require our manufacturing partners to provide products that comply with applicable U.S. consumer product safety requirements, including:
FCC Part 15 (radio frequency and electronic device emissions)
Applicable CPSC regulations and safety standards for consumer electronic products
Applicable ASTM standards where relevant to this product category
Any certifications, test reports, compliance documentation, or safety representations relating to the materials, electronics, battery, assembly, or performance of the product originate from the supplier or manufacturer and are supplier representations only. They are not independent compliance attestations made by Grimzap.
No representation or warranty is made by Grimzap that the product meets all applicable safety standards under all conditions of use.
CALIFORNIA PROPOSITION 65 WARNING: This product can expose you to chemicals including lead and phthalates, which are known to the State of California to cause cancer, birth defects, or other reproductive harm. For more information, go to www.P65Warnings.ca.gov.
11. ASSUMPTION OF RISK
You voluntarily assume all risks associated with the use or misuse of the product, including but not limited to:
Electrical or shock risks arising from exposing the non-waterproof handle/motor unit, charging cable, or charging connection to water or moisture
Injury from the moving brush head, including entanglement of hair, clothing, or jewelry, or skin abrasion
Eye, skin, or respiratory irritation or injury from splashing, fumes, or contact with water, debris, or cleaning chemicals used with the device
Damage to surfaces, fixtures, or property being cleaned
Physical strain, discomfort, or injury arising from the physical activity of cleaning
Risks arising from using the device on people, animals, skin, hair, or the body, contrary to these Terms
Any injury, loss, or damage arising from misuse, improper use, unauthorized modification, or failure to discontinue use upon observing any problem
Your purchase and use of this product constitutes your voluntary assumption of these risks.
12. PRODUCT PRESENTATION DISCLAIMER
Product images, videos, descriptions, testimonials, and marketing materials are for illustrative purposes only.
Actual product appearance, materials, packaging, or performance may vary.
Before-and-after images and cleaning results shown in marketing materials are illustrative and will vary based on the surface, the type and amount of grime, the cleaning products used, and how the device is used. Testimonials and reviews reflect individual experiences and do not represent typical results. No representation is made that any testimonial result is typical or achievable by consumers generally.
We reserve the right to modify or discontinue products at any time without notice.
13. ORDERS AND BILLING
All orders constitute an offer to purchase and may be accepted or rejected at our discretion.
Orders generally cannot be modified or canceled once placed.
You authorize us to charge your selected payment method for all amounts due.
We reserve the right to cancel orders suspected of fraud, abuse, or unauthorized resale.
14. SHIPPING AND INTERNATIONAL FULFILLMENT
Orders ship directly from international fulfillment partners, primarily located in China, to the customer in the United States. Goods do not transit through Germany at any point.
Grimzap does not maintain warehousing, retail, or fulfillment operations in either the United States or Germany.
You acknowledge that:
Delivery times are estimates, not guarantees
Delays due to customs or carriers may occur
Accurate shipping information is your responsibility
Orders marked as delivered by the carrier are considered fulfilled
15. RETURNS AND PAYMENT DISPUTES
Returns and refunds are governed by our Refund Policy, including the 30-day satisfaction guarantee.
We reserve the right to contest improper chargebacks or abusive dispute behavior.
Customers engaging in excessive or fraudulent disputes may be refused future service.
16. USER CONTENT LICENSE
By submitting reviews, images, videos, or other content, you grant Grimzap a perpetual, worldwide, royalty-free, irrevocable license to use such content for marketing, promotional, and business purposes.
17. INTELLECTUAL PROPERTY
All content on the Services is owned by Grimzap or its licensors and protected by intellectual property laws.
Unauthorized use is prohibited.
18. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE".
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Nothing in this section limits or excludes any warranty or other right that cannot be limited or excluded under applicable law.
19. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM USE OR MISUSE OF THE PRODUCT.
20. INDEMNIFICATION
You agree to indemnify and hold Grimzap harmless from any claims, damages, or expenses arising from misuse of the product or violation of these Terms.
21. INFORMAL DISPUTE RESOLUTION
Before initiating arbitration, you agree to contact support@grimzap.com and allow 30 days for informal resolution.
22. ARBITRATION AND CLASS ACTION WAIVER
Any dispute shall be resolved by binding arbitration under the Federal Arbitration Act, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration shall be conducted on an individual basis
No class actions or representative claims
Arbitration may take place remotely or in New York, New York
Small claims court remains permitted
Opt-Out: You may opt out within 30 days of purchase by emailing support@grimzap.com with your full name and order number.
23. GOVERNING LAW
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, and without depriving consumers of mandatory rights under applicable consumer protection laws, including those of their state of residence.
24. ELECTRONIC COMMUNICATIONS
You consent to receive communications electronically.
25. FORCE MAJEURE
We are not liable for delays or failures caused by events beyond our reasonable control.
26. SEVERABILITY AND ENTIRE AGREEMENT
If any provision is deemed invalid, the remaining provisions remain enforceable.
These Terms constitute the entire agreement between you and Grimzap.
